§ 2. Definitions
Customer: a natural person, legal person or organisational unit buying in the Shop.
Consumer: a natural person buying for purposes not directly connected with their business or profession.
Sole trader with consumer rights: a natural person running a sole proprietorship whose purchase is not of a professional nature, as shown in particular by the business activity entered in CEIDG. They have the same rights as a Consumer in the matters of § 10 and § 11 and as to unfair contract terms.
Product: a 4K UHD Blu-ray disc (also in a steelbook or box set) offered in the Shop. Order: the Customer's declaration made through the order form. Contract: the contract of sale of Products concluded through the Shop.
On-demand Product: a Product that we order from the distributor after the payment is booked; its page marks it "on demand".
§ 3. Services in the Shop
We provide free of charge: browsing the catalogue and search, the basket, the order form and the parcel pick-up point search.
You order without creating an account. The basket and the form work for as long as you use them; you can stop at any time.
You need a device with internet access, an up-to-date browser with cookies enabled and an e-mail address. The cookies we use are described in the Privacy policy.
Unlawful content must not be sent through the Shop.
Send comments on how these services work by e-mail. We answer within 14 days.
§ 4. Ordering and the contract
To order, add Products to the basket, enter your details and delivery method in the form, accept these Terms and click “Order with obligation to pay”. Clicking it places an order with an obligation to pay.
Before you click, the form shows the price of the Products, the delivery cost and the total to pay.
Placing an Order is your offer to buy. When the Contract is concluded depends on how you pay on the site you buy on (§ 14). We send a confirmation of the Order, with these Terms, to the e-mail address you give.
We reserve the ordered Products for the payment time shown when you place the Order and on the Order page. If payment does not arrive in that time, the reservation lapses and you owe nothing.
If payment arrives after the reservation ends, we accept it as long as the copy is still free, and the Contract is concluded. Many Products are single copies; if the copy is gone, no Contract is concluded: we tell you at once and refund the full amount within 14 days at the latest.
§ 5. Products and prices
Products are new and in the manufacturer's original foil. Each Product's description gives the edition and the audio and subtitle languages on the 4K disc that we know of.
A 4K UHD Blu-ray disc needs a 4K UHD Blu-ray player or a console with a 4K UHD drive. A regular Blu-ray player cannot read it.
Prices are gross prices in the currency of the site you buy on (złoty on steelnoir.pl, euro on steelnoir.com) and include VAT. Delivery is charged separately; the form shows it before you place the Order.
With every price reduction we also show the lowest price of the Product in the 30 days before the reduction.
One discount code can be used per Order. The code's conditions are given with it.
§ 6. Payment
You pay in advance. The payment provider and the ways to pay are in § 14 and on the Delivery and payment page. We do not offer cash on delivery.
The payment time is shown when you place the Order and on the Order page; it runs from the moment you place the Order (§ 4(4)).
We send refunds by the method you paid with, unless you agree to another one at no cost to you.
§ 7. Delivery
On steelnoir.pl we deliver within Poland, and the delivery countries of steelnoir.com are listed on its Delivery and payment page. Delivery methods, their prices and the basket value from which delivery is free are shown on the Delivery and payment page and in the order form.
We hand the parcel to the carrier within 24 hours of the payment being booked, except for Orders with a pre-order or on-demand Product. We do not send parcels on Saturdays, Sundays and public holidays, so then it goes on the next working day. Carriers usually deliver in 1–2 working days.
Look at the parcel when you receive it. If it is damaged you may write a damage report with the courier; it helps but is not a condition of a complaint (§ 11).
If a parcel comes back to us unclaimed, we write to you by e-mail. You can ask us to send it again at the price of a new delivery, or for a refund: we return the full amount you paid, with delivery up to the price of the cheapest delivery in the shop, within 14 days. If you don't answer within 14 days, we refund you the same way.
§ 8. Pre-orders
A Product marked as a pre-order shows the date from which we send it. You pay when you order.
We state the latest shipping date before you place the Order and in the e-mail confirming it. If we miss it, you may cancel and get the full amount back within 14 days.
If the publisher moves the release, we e-mail you the new date. You may wait, or cancel and get the full amount back within 14 days.
We send an Order containing a pre-order Product in one parcel, once all its Products have arrived.
Before release, publishers usually announce only some of the languages. A pre-order's description lists those we know when you order; the other audio tracks and subtitles we learn only from the finished disc.
The withdrawal period (§ 10) runs from the day you receive the parcel. If the disc lacks a language you were counting on, you may return it in its unopened foil.
The number of pre-order discs may be limited. If the publisher delivers fewer discs to us, we send them in the order payments were made and refund the full amount for the remaining orders.
§ 9. On-demand Products
We order a Product marked "on demand" from the distributor after your payment is booked. We state the latest shipping date, counted from the day of payment, on the Product page and before you place the Order; the e-mail confirming the Order repeats it.
We send an Order containing an on-demand Product in one parcel, once all its Products have arrived.
If we learn that we will miss the date or cannot deliver the Product, we write to you at once and before that date. You may then, on the Order page or by e-mail: (a) wait, (b) for an Order of several Products, take the rest and withdraw from the Contract for the missing Product, or (c) withdraw from the whole Contract. If you do not choose, the Contract stands and we deliver the Product as soon as it reaches us. Your rights under art. 543¹ § 2 of the Civil Code are not affected.
If you withdraw from the Contract in whole or in part, we refund the money within 14 days of your choice, by the payment method used.
§ 10. Withdrawal from the contract
A Consumer or a sole trader with consumer rights may withdraw from the Contract without giving a reason within 30 days of receiving the Product. The law gives 14 days; we give 30 days.
It is enough to send a statement before the period ends, for example by e-mail to contact@steelnoir.com. You may use the model withdrawal form, but you don't have to. You can also withdraw with the "Withdraw from contract here" link in the footer of every page, or on your order page; we confirm it automatically by e-mail. The other ways remain available.
Send the Product back within 14 days of withdrawing, to the address shown on the Returns page. You pay for sending it back.
We refund all payments, including delivery to you (up to the cheapest delivery method in the Shop), within 14 days of receiving your statement. We may hold the refund until we receive the Product or proof that it was sent.
You are liable for any reduced value of the Product caused by handling it beyond what is needed to establish its nature and characteristics.
There is no right of withdrawal for video recordings delivered in sealed packaging if the packaging was opened after delivery (art. 38(1)(9) of the Polish Consumer Rights Act). In the Shop, sealed packaging means the manufacturer's original foil: a disc with the foil removed cannot be returned. A faulty disc with the foil removed is a complaint (§ 11).
§ 11. Complaints
We are liable for the Product's conformity with the contract, including its description in the Shop as it stood when you placed the Order, if the lack of conformity existed at delivery and shows within 2 years.
If the Product does not conform, you may ask for a replacement or repair, and if that is impossible, fails or we refuse, for a price reduction or to withdraw from the Contract. We usually replace discs; if we have no other copy, we refund the money.
Write to contact@steelnoir.com: the order number, what is wrong and what you ask for; a photo helps. We pay for sending a faulty Product back. The address is on the Returns page.
We answer within 14 days. If we do not answer in that time, a Consumer's complaint is deemed accepted.
A Consumer keeps any longer or better guarantee rights that the law of the country where they live gives them.
§ 12. Out-of-court dispute resolution
A Consumer may get help from a municipal or district consumer ombudsman, a regional Trade Inspection office or a permanent consumer arbitration court. Information is at uokik.gov.pl. A Consumer in another EU country may also turn to the European Consumer Centres network (ECC-Net).
We have not undertaken to use out-of-court dispute resolution, but a Consumer may still ask for it. We decide on taking part in such proceedings case by case. If a complaint ends without agreement, we will tell you on paper or another durable medium whether we agree to proceedings before the body you chose.
§ 13. Receipts and invoices
We issue a receipt for every sale.
If you buy for a business, tick that in the form and give the company name and your VAT or tax number; we will issue a VAT invoice. Polish rules do not allow an invoice for a receipt issued without a VAT or tax number.
§ 14. Buying on steelnoir.pl / on steelnoir.com
On steelnoir.pl you pay in złoty through Przelewy24: by fast bank transfer or BLIK. Payments are processed by PayPro SA (Przelewy24). The Contract is concluded when Przelewy24 confirms the payment.
On steelnoir.com you pay in euro by payment card, Apple Pay or Google Pay, on the payment page of Stripe Payments Europe, Limited (Ireland). We do not see or store your card number. We first hold the amount on your card. The Contract is concluded when we take the payment, once your copy is secured (for a pre-order or on-demand disc: once a place for it is secured for you). If the copy or the place is gone, we release the hold, no Contract is made and you are not charged. Some banks keep showing a released hold for a few days.
On steelnoir.pl the Polish text is binding and on steelnoir.com the English text; on the other site each is a translation. We give the delivery countries and prices of each site on its Delivery and payment page. Polish law applies on both sites: on steelnoir.com English is only the language of the contract and does not change the applicable law. A Consumer keeps the protection that the mandatory rules of the country where they live give them. A Consumer may also sue us in the courts of the country where they live, and we may sue a Consumer only there (art. 18-19 of the Brussels I bis Regulation).
§ 15. Changes to the Terms and final provisions
We may change these Terms for a valid reason, for example a change in the law, new payment or delivery methods or new services. We publish the new version at least 7 days before it takes effect.
Orders placed before a change are handled under the Terms in force on the day of the Order. Earlier versions are available on this page.
These Terms are governed by Polish law, on both sites. Nothing in them limits the rights a Consumer or a sole trader with consumer rights has under the law.
We process personal data as described in the Privacy policy.
